AGREEMENT TO TERMS

These Terms of Use ("Terms") constitute a legally binding agreement between you and Adult Supervision LLC ("Company," "we," "us," or "our") governing your access to and use of the Nutrition X-Ray mobile application ("App") and website at nutritionxray.com ("Site").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

PERMITTED USE

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes.

You may use Nutrition X-Ray to:

• Scan barcodes to look up ingredient information for personal reference.
• Review flagged ingredients (sugar, dairy, gluten aliases) in food products.
• Maintain a personal scan history (Premium subscribers).

USER ACCOUNTS

Creating an account is optional for free users. Paid subscribers may be required to create an account to sync scan history across devices.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us immediately of any unauthorized access at support@nutritionxray.com.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or are otherwise misused.

SUBSCRIPTIONS

Nutrition X-Ray offers the following paid options:

• Monthly: $2.99/month — auto-renewing subscription for unlimited scans and premium features.
• Annual: $14.99/year — auto-renewing annual subscription at a discounted rate.
• Lifetime: $29.99 — one-time purchase granting permanent access to all current features and future feature updates.
• Free Tier: 15 scans per month at no charge, with no subscription required.

All subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Payment is charged to your Apple ID or Google Play account upon confirmation of purchase.

Cancellations: You may cancel at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial subscription periods except where required by law.

Price changes: We reserve the right to change subscription pricing with reasonable notice. Continued use after a price change constitutes acceptance of the new price.

Lifetime access: Lifetime purchasers receive access to all features available at the time of purchase plus future feature updates, for as long as the App is maintained. In the unlikely event the App is discontinued, no refund or alternative is guaranteed beyond what Apple/Google require.

NOT MEDICAL ADVICE

The App surfaces ingredient data to help you identify common allergens and additives. It is your responsibility to:

• Consult a qualified healthcare provider or registered dietitian before making significant dietary changes.
• Not rely solely on this App to manage food allergies, celiac disease, diabetes, or any other medical condition.
• Verify ingredient information independently, especially for severe allergies or medical dietary requirements.
• Understand that ingredient databases may be incomplete, outdated, or inaccurate for some products.

We expressly disclaim any liability for dietary decisions made based on information provided by this App.

INGREDIENT DATA

Ingredient data displayed in Nutrition X-Ray is sourced from Open Food Facts, USDA FoodData Central, and other public databases. This data is contributed by the public and government sources and may be:

• Incomplete or missing for some products.
• Outdated (manufacturers change formulations without updating databases).
• Incorrect due to data entry errors by third parties.
• Unavailable for regional, private-label, or newly released products.

We make no warranty that the ingredient data is complete, accurate, current, or suitable for any particular dietary need. Always verify with the physical product label for critical dietary decisions.

OUR IP

The App, including its design, code, branding, logos, and all content we create (excluding third-party database data), is owned by Adult Supervision LLC and protected by applicable intellectual property laws.

You may not copy, modify, distribute, sell, reverse engineer, decompile, or create derivative works from the App without our express written permission.

The Nutrition X-Ray name, logo, and associated trademarks are property of Adult Supervision LLC.

WHAT YOU MAY NOT DO

• Use the App for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorized access to our systems, servers, or databases.
• Scrape, crawl, or systematically extract data from the App or Site.
• Use automated tools to make excessive API calls or place undue load on our infrastructure.
• Misrepresent your identity or impersonate another person or organization.
• Circumvent subscription restrictions or attempt to use premium features without paying.
• Resell or commercially distribute access to the App or its data without authorization.
• Upload or transmit malicious code, viruses, or harmful content of any kind.

AS-IS WARRANTY

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant that ingredient data will be accurate, complete, or current.

Some jurisdictions do not allow exclusion of implied warranties, so some of the above may not apply to you.

LIABILITY LIMIT

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ADULT SUPERVISION LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $50 USD.

This limitation applies regardless of whether the claim is based in contract, tort, negligence, strict liability, or any other theory, even if we have been advised of the possibility of such damages.

GOVERNING LAW

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions.

Any dispute arising from these Terms or your use of the App shall be resolved through binding arbitration under the American Arbitration Association's Consumer Arbitration Rules, except that either party may seek injunctive relief in court for intellectual property disputes.

You waive any right to participate in class action lawsuits or class-wide arbitration to the extent permitted by law.

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
